INTRODUCTORY

Compulsory Registration Scheme

Ministry of Electronics and Information Technology (MeitY) has notified “Electronics and Information Technology Goods (Requirements for Compulsory Registration) Order, 2012” on 3 Oct 2012 mandating Compulsory Registration from BIS for Electronics and Information Technology (IT) products. BIS had also notified a separate ‘Standard Mark’ for the Registration Scheme.
This Scheme basically is for the manufacturer (Domestic and Foreign) of electronics and IT products where they cannot sell, import or store the products without the Standard Mark. As per the Scheme, products need to be complied as per Indian Standards by BIS for the sake of safety of consumers and manufacturer himself makes a declaration that his product conforms to the Indian Standard before launching in the market.

Who is eligible to apply?

Manufacturer (factory owner) of any product, which comes under the ambit of the Compulsory Registration Order (CRO) notified by Ministry of Electronics and Information Technology (MeitY) or Ministry of New and Renewable Energy (MNRE).

Authorized Indian Representative or Local Representative:

AIR (Authorized Indian Representative) is primarily to represent the enterprise in Regulatory matters with the BIS.
 In case of Foreign Applicant/ Manufacturer outside India they need to nominate a company in India as AIR. Nominating AIR Can be any one as below:
• If manufacturer has its liaison office/ Subsidiary firm/ branch office located in India, then they will be nominated as the AIR.
• If manufacturer does not have a liaison office /subsidiary firm/ branch office located in India, but Proprietor/Registered user/subsidiary firm/liaison office of the Brand/Trademark appearing on the article is located in India, then they will be nominated as the AIR.
• If manufacturer does not have a liaison office / subsidiary firm/ branch office located in India and there is no Proprietor / Registered User/subsidiary firm/branch office/ liaison office of the Brand/Trademark appearing on the article, located in India. Therefore, they can nominate the major importer/distributor/ entity having marketing tie-up with the brand owner and /or the manufacturer, nominated as AIR.
 In case of Domestic Applicant, they themself act as AIR .
